We can see that it can be all too easy for detained patients not to be fully aware of their rights, and if they are, they may not be assisted to exercise these rights. Also, as Hale (2010: p211) states, while there is no legal duty to do so, the MHA Code states that hospital managers need to make sure that informal patients are informed of their rights, otherwise there is a risk of unlawful detention. Therefore, it is important that social workers working with these patients endeavour to ensure that they are able to understand their rights and exercise them if they so wish.
